Terms of Service

Clear rules for a great experience — for travelers and guides alike.

1. Platform Role

Moonty (moonty.travel) is a marketplace platform that connects travelers with independent local guides in Nanjing, China. Moonty provides technology and tools to facilitate bookings, payments, and communication. Guides listed on Moonty are independent service providers — they are not employees, contractors, or agents of Moonty.

By using Moonty, you agree to these Terms of Service. If you do not agree, please do not use the platform.

2. Eligibility and Accounts

You must be able to form a legally binding agreement to use Moonty. You are responsible for your account and for all activity under it.

  • You must be at least 18 years old to create an account or make a booking.
  • You agree to provide accurate, current, and complete information and keep it updated.
  • You are responsible for keeping your login credentials confidential and notifying us promptly of unauthorized use.
  • If you use Moonty on behalf of a business, guide team, or other organization, you represent that you have authority to bind that organization.

3. Bookings & Payment

When you book a tour on Moonty:

  • Booking process: Select a tour, choose your date and number of guests, and complete payment. Your booking is confirmed once payment is successfully processed.
  • You will receive a confirmation email with your booking details. The guide will contact you separately to confirm the meeting point and any final details.
  • Currency: All prices are displayed and charged in US Dollars (USD). No hidden fees are added by Moonty — the price shown is the price you pay.
  • Payment security: All payments are processed by Stripe, a PCI DSS-certified payment provider. Moonty does not store your full card details.
  • Availability: Tour availability, meeting points, routes, and guide details may change. We will make reasonable efforts to notify you of material changes.
  • Service fees and taxes: If Moonty adds platform fees, taxes, or other charges, they will be disclosed before checkout.

4. Cancellation & Refunds

We understand that travel plans change. The following cancellation policy applies to all bookings on Moonty:

Standard cancellation policy:

  • More than 48 hours before the tour start time: Full refund, no cancellation fee.
  • 24 to 48 hours before the tour start time: 50% refund.
  • Less than 24 hours before the tour start time, or no-show: No refund.
  • Force majeure (severe weather, natural disaster, government-issued travel restriction, or other circumstances beyond reasonable control): Full refund, regardless of notice period. This applies to both traveler and guide cancellations.

To cancel a booking, go to My Bookings in your dashboard and select Cancel. Approved refunds are returned to the original payment method within 5–10 business days.

If a Guide cancels your confirmed booking for any reason, you will receive a full refund regardless of timing. Moonty will notify you by email as soon as we are informed.

If you believe a cancellation or refund was handled incorrectly, contact support@moonty.travel within 14 days of the tour date or cancellation decision.

5. Your Responsibilities (Travelers)

As a traveler using Moonty, you agree to:

  • Provide accurate information when registering and making bookings, including the correct group size, date, and any relevant needs or restrictions.
  • Comply with all applicable local laws, regulations, and customs during your tour. You are responsible for holding any required travel documents.
  • Take responsibility for your own personal safety and the safety of members in your group. Moonty does not provide safety supervision or insurance.
  • Obtain appropriate travel insurance before your trip. Moonty strongly recommends insurance covering medical expenses, trip cancellation, and personal liability.
  • Treat guides with respect and arrive on time at the agreed meeting point. Repeated no-shows or abusive behavior may result in account suspension.
  • Understand that travel, walking tours, public spaces, weather, traffic, food, crowds, and local activities involve inherent risks that cannot be fully eliminated.

6. Guide Responsibilities

By accepting a booking through Moonty, the guide agrees to:

  • Arrive on time at the meeting point specified in the tour listing.
  • Maintain professional conduct throughout the tour and treat travelers with respect.
  • Deliver the tour content substantially as described in the Moonty listing. Any significant changes must be communicated to the traveler in advance.
  • Notify travelers and Moonty promptly if the guide needs to cancel or significantly modify a booking. Last-minute cancellations without cause may affect the guide's standing on the platform.
  • Hold any licenses, permits, registrations, insurance, or qualifications required by applicable law for the services offered.
  • Comply with applicable tax, invoicing, consumer protection, safety, and local business rules.

7. Guide Payouts, Taxes, and Records

Guide payout features may be provided through Stripe or other payment partners. Payout timing, verification, fees, and availability may depend on the payment partner, local law, and successful completion of required onboarding.

  • Guides may need to provide identity, tax, bank, and business information directly to Stripe or another payout provider.
  • Guides are responsible for determining, collecting, reporting, and paying any taxes, duties, or government charges related to their services and payouts.
  • Moonty may delay or withhold payouts where reasonably necessary for fraud prevention, chargebacks, disputes, refunds, legal compliance, or violation investigation.

8. Prohibited Conduct

You agree not to misuse Moonty or harm other users. Prohibited conduct includes:

  • Using the platform for illegal, unsafe, discriminatory, deceptive, or abusive activity.
  • Circumventing Moonty fees, payments, cancellation rules, or safety systems by moving bookings off-platform.
  • Harassing, threatening, abusing, doxxing, or discriminating against travelers, guides, or our team.
  • Submitting false listings, fake reviews, misleading credentials, unauthorized payment methods, or fraudulent refund claims.
  • Scraping, reverse engineering, overloading, interfering with, or attempting unauthorized access to the platform.

9. Reviews and User Content

Reviews, photos, messages, guide profiles, and other user content must be truthful, lawful, and respectful. You represent that you own or have permission to submit the content you provide.

Moonty may remove, limit, or edit visibility of content that appears unlawful, misleading, abusive, private, infringing, spammy, unsafe, or inconsistent with these Terms.

10. Disclaimers and Limitation of Liability

Moonty is an intermediary platform. Moonty is not directly responsible for the quality, safety, legality, or accuracy of any guide service offered on the platform. Guides are solely responsible for the services they deliver.

Moonty is not liable for personal injury, property damage, financial loss, or any other harm arising from your use of guide services booked through the platform. To the fullest extent permitted by applicable law, Moonty's total liability to you for any claim arising from use of the platform is limited to the amount you paid for the specific booking in question.

The platform is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted availability, error-free operation, specific tour outcomes, guide availability, or that user content is complete or accurate.

If you experience a problem with a booking or a guide, please contact us at support@moonty.travel. Moonty will make reasonable efforts to mediate disputes between travelers and guides but cannot guarantee specific outcomes or resolution timelines.

11. Intellectual Property

All content on the Moonty platform — including text, logos, graphics, interface design, and software — is owned by or licensed to Moonty and is protected by copyright and other intellectual property laws. You may not copy, reproduce, or distribute any Moonty content without prior written permission.

By submitting a review, photo, or any other content to Moonty, you grant Moonty a non-exclusive, royalty-free, worldwide license to display, reproduce, and use that content on the platform and in promotional materials related to Moonty.

12. Changes to These Terms

Moonty may update these Terms of Service from time to time. If we make material changes, we will notify you by email or by posting a notice on the platform at least 7 days before the changes take effect. Your continued use of Moonty after the effective date of the updated Terms constitutes your acceptance of the revised Terms.

13. Suspension and Platform Changes

Moonty may suspend, restrict, or terminate access to the platform if we reasonably believe a user has violated these Terms, created risk for others, engaged in fraud or abuse, or if required by law. We may also modify, pause, or discontinue features as the platform evolves.

14. Third-party Services

Moonty integrates with third-party services such as Stripe, Supabase, Vercel, Ably, UploadThing, AMap, Sentry, and email providers. Their services may be governed by their own terms and privacy policies. Moonty is not responsible for third-party services outside our control.

15. Indemnity

To the fullest extent permitted by law, you agree to indemnify and hold Moonty harmless from claims, losses, liabilities, damages, costs, and expenses arising from your content, your services, your violation of these Terms, your violation of law, or your infringement of another person's rights.

16. Governing Law

These Terms of Service are governed by the laws of the People's Republic of China. Any disputes arising out of or in connection with these Terms shall be submitted to the competent courts in Nanjing, Jiangsu Province, China for resolution.

Nothing in these Terms limits any mandatory consumer protection rights that cannot be waived under the laws applicable to you.
